mulliganing while acknowledging D/DL Prob

Hi theres
We are looking for an O, if possible, since there's disagreement about this scenario (this actually happened).

A player draws 7 at start of game. He announces “mulligan”, puts the card back into his deck and then immediately calls for a judge.
He has just realized he has failed to desideboard. There's disagreement if, provided we downgrade the penalty, he should be drawing 6 or 5 (or maybe downgrade is not applicable at all).

Thanks, bye!
Donato

Not that long ago, this was simply a Game Loss. When we implemented the “Head Judge may downgrade” clause, it was in an effort to reward an honest player, for calling attention to his own mistake. We agreed that the remedy - drawing a hand with one less card - was necessary to maintain a reasonable risk/reward ratio - i.e., to discourage trying to take advantage of this downgrade.

This player is already committed to drawing a six-card opening hand; we assess the infraction, record the Warning, and have him draw a five-card hand instead of six.
