Milan mentioned the Jackie Lee DQ from Pro Tour RTR two years ago. I read her whole article, and I also read Toby Elliott's article. I think the important difference is, that she was asked by the judges if she knew she had to call a judge if she notices a life discrepancy, which she confirmed - she has read about the rule before, but didn't remember exactly how it worked. By that, she fulfilled all criteria for UC-Cheating: She did it on purpose, she knew it was wrong, and she did it to get an advantage over her opponent.

In this case, we should investigate and talk to Ashnod, and try to find out if he knew he had to call a judge. In the MTR it says, players are responsible for:
- Calling attention to any rules or policy infraction they notice in their matches.
- Being familiar with the rules contained within this document.

Glenn already clarified that Ashnod knew all along that Nefarox announced an incorrect life total. Maybe Scott can clear up if MTRs “Failure to do so will be considered a Unsporting Conduct – Cheating penalty” will override the IPGs “The player must be aware that he or she is doing something illegal”.

Like Jackie said in her article: “So was it cheating, or not? Can someone accidentally cheat?”

Yeah, I got the point. Thanks a lot for the clarification!

I actually mixed up two different things: UC-Cheating and UC-Bribery and Wagering (my mind is full of a recent local case of bribery I was investigating, where the bribing players didn't realize their behavior was against the rules).

The MTR can state “this is Cheating” all it wants to, but the IPG still defines what we do about Cheating - and that includes applying the criteria in the IPG.

Note that the clause “player must be aware that he or she is doing something illegal” does not exempt players from DQ for rolling a die to determine a winner, or offering a bribe. Those are two examples where we have zero tolerance for the “ignorance excuse”. And not pointing out a life total discrepancy is nearly as fundamental of a concept, so it should be pretty hard to convince a judge that you somehow didn't know that…

Keep in mind the Jackie Lee DQ was the product of a previous version of the IPG. I don't believe it's appropriate to cite it as relevant precedent any longer.
